Caption Contest Rules

THE PRICE IS RIGHT® CAPTION CONTEST CONTEST 2016

ELIGIBILITY REQUIREMENTS & TERMS AND CONDITIONS

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED BY LAW.

 

MESSAGE / DATA RATES MAY APPLY IF USING A MOBILE DEVICE TO ENTER THE CAPTION CONTEST.

 

Facebook is in no way affiliated or associated with this Caption Contest (as defined below), and shall have no liability for any claims, issues or causes of action related to or arising from or out of the Caption Contest.
The Price Is Right Productions, and its distribution, production, administrative, advertising, and promotion agencies (“TPIR”) invite you to join in on the fun of THE PRICE IS RIGHT Caption Contest (the “Caption Contest”) for Season 44 of The Price Is Right (the “Show”). For details on how to participate, see below in HOW TO ENTER.

 

HOW TO ENTER:

  1. Visit the Show Facebook page at https://www.facebook.com/ThePriceIsRightCBS (“TPIR FB Page”) during the Contest Period.
  2. To enter:
    1. Follow TPIR FB Page;
    2. LIKE the photo from the daily Caption Contest; AND
    3. Post a comment captioning the photo (“Caption”). Your caption should include the hashtag #TPIRCaptionContest.

Your entry will only be counted if it appears in TPIR FB Page newsfeed (i.e., is actually posted to the feed) and visible to the public (i.e., not just your Facebook friends)

 

Private Facebook posts, or a Facebook post only visible to your Facebook friends will not constitute an entry into the Caption Contest.

 

Your Caption must be be original, and not infringe on any third party rights, including without limitation, copyright, trademark, or patent, or create claims for idea misappropriation or breach of contract. Your Caption must not be defamatory, derogatory, insulting or otherwise denigrating. Your Caption must conform to the official Facebook terms of service (https://www.facebook.com/legal/terms).

 

TPIR will only review the FIRST Caption you submit (based on the timestamp on Facebook). If you submit multiple Captions, only the first Caption will be reviewed.

 

A valid Facebook account is required to enter into this Caption Contest. Facebook accounts are free. To set up a Facebook account, visit https://www.facebook.com/help/345121355559712.

 

In order to participate, you must meet the following eligibility criteria:

 

  • You must be eighteen (18) years of age or older at the time of application.
  • You must be a legal resident of the United States (excluding Puerto Rico) and live in the United States as of the date you submit your Caption.
  • Satisfy the Terms of Participation (see below).
  • Have a valid Facebook account.

 

Employees, officers, directors and agents of CBS Corporation, CBS Broadcasting Inc., The Price Is Right Productions, Inc., Fremantle Goodson, Inc., or Fremantle Media North America, Inc. (and any parent, subsidiary, or affiliate of any of the foregoing), and local and national sponsors of THE PRICE IS RIGHT and/or of any of their respective licensees, assigns, partners, parents, subsidiary, or affiliated companies and their immediate family (spouse, mother, father, sister, brother, daughter or son, regardless of where they live) or members of their same households (whether related or not) are not eligible to be participants in the Caption Contest or participate in the application process.

 

You are required to provide truthful information and TPIR may reject and require deletion of any entry that it discovers or determines to be false or fraudulent. TPIR may disqualify any entry from individuals who do not meet the eligibility requirements.

 

Your Caption must NOT contain material which is sexually explicit, obscene, pornographic, violent (for example, relating to murder, weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, national origin, physical disability, sexual orientation or age), illegal (for example, underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane or harassing.

 

Contest Submission Phase

The Caption Contest will be open beginning on Monday, January 15, 2016 and ending on Friday, January 29, 2016 (the “Contest Period”). Each day during the Contest Period, submissions will be accepted for that day’s contest only, beginning at 12:00:00pm PST and ending at 6:00:00pm PST. Only Captions for the applicable day’s contest submitted between 12:00:00pm PST and 6:00:00pm PST on the applicable day will be entered into the judging phase as described below.

 

TPIR shall act as official timekeeper, and all decisions regarding timing of entries shall be at TPIR’s sole discretion.

 

Judging

 

Your Caption may not exceed space or length restrictions imposed by Facebook.

 

The top five (5) Captions with the most “likes” from the general public will be reviewed and judged by TPIR (“Top 5”). The Top 5 will be judged by personnel from THE PRICE IS RIGHT based on the following criteria: 33.3% creativity, 33.3% adherence to Show brand values and tonality, and 33.3% grammar, clarity and general presentation. In the event of a tie, the entry with the higher score in the creativity category will be declared the finalist.

 

TPIR reserves the right to edit, modify or reword Captions for purposes of clarity, grammar or content. Captions that violate Facebook’s terms of service shall be disqualified and removed from the TPIR FB Page.

 

Winner Selection and Announcement

 

TPIR will select one (1) finalist (the “Finalist”) from among the Top 5. The Finalist will not be officially declared until such individual fills out, signs and returns all required paperwork, which may include a Release and Waiver.

 

All of TPIR’s decisions with respect to the Caption Contest are final and in TPIR’s sole and absolute discretion.

 

The winners from Monday through Thursday of the Contest Period will be announced within the broadcast of the Show on the following day, as applicable. The winner from Friday, January 29, 2016 will be announced via social media on Monday, February 1, 2016.

 

Prize (the “Prize”)

Total value of Prizing: $1,308.92

 

The Prize winner also will be responsible for any taxes related to this contest and/or prizes won as a result of his/her participation as a contestant in an episode of THE PRICE IS RIGHT, if any.

 

TPIR may elect, in its sole discretion, to feature Captions submitted as part of the Caption Contest in one or more episodes of THE PRICE IS RIGHT or related promotional materials.

 

TPIR reserves the right to change or make exceptions to any of the rules, eligibility requirements and terms, including the terms of any prizes to be awarded at any time without notice.

 

TPIR reserves the right to add, cancel and/or substitute other means of participation and TPIR reserves the right to modify the manner in which the Caption Contest is conducted.

 

Other Conditions (the “Terms of Participation”)

Payment of all federal, state and local taxes is the sole responsibility of the Finalist. The Finalist may be required to complete and submit an IRS Form W-9 with his/her full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by TPIR in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the Prize. Such winnings of $600 or more will be reported to the IRS.

 

Participation in the Caption Contest and/or acceptance of the Prize constitutes entrant’s and/or winner’s permission for TPIR or its agents and designees to interview the Finalist, to photograph, film, and record the Finalist, and to use in commerce and in any and all media, worldwide, now known or hereafter devised, in all versions and in perpetuity, his/her name, address (city and state), biographic information, likeness, photograph, audio or Caption recording, and/or any statements made by him/her regarding TPIR, the Caption Contest, and/or its sponsor(s) for purposes of trade, publicity, or promotion without notice or additional compensation, except where prohibited by law. The Finalist agrees to sign a publicity release confirming such consent prior to acceptance of the prize, except where prohibited by law.

 

If selected as the Finalist, you may also be required to meet with the press to promote your participation in the Caption Contest and winning the Prize.

 

You understand that although you may believe your Caption to be unique and novel, there may be pre-existing ideas, concepts, or proposals that are similar to your Caption. By submitting your Caption, you recognize that other persons, including TPIR’s own employees, may have submitted to TPIR or others, or made public, or may in the future originate and submit or make public, similar or identical ideas, concepts, or proposals that TPIR may have the right to use, and you understand that you will not be entitled to any compensation because of TPIR’s use of such similar or identical ideas, concepts, or proposals in any manner. You understand and agree that TPIR’s use of material containing features or elements similar or identical to those contained in your Caption will not obligate TPIR to negotiate with you or entitle you to any compensation if TPIR determines that it has an independent legal right to use that other material for any reason (for example, because the features or elements are not new or novel, were not originated by you, or were or may hereafter be independently created and submitted by other persons, including TPIR employees).

 

By submitting your Caption, you agree that your Caption, in whole or in part and as edited by TPIR in its sole discretion, may be exhibited in the Show (distributed in all media, worldwide), on the Show’s websites (collectively, the “Website”) and in advertising for the Show on-air and off-air and on the Website and on social media platforms related to the Show (together, the “Materials”) and that TPIR may exploit your Caption and the Materials howsoever it chooses in any and all markets and media now known or hereafter devised, throughout the world in perpetuity, without additional notification, permission, approval, or compensation.

 

You grant TPIR, FremantleMedia North America, Inc., Fremantle Goodson, Inc., CBS Corporation, CBS Broadcasting Inc., and their respective parent, subsidiary, and affiliate companies, and their licensees, successors and assigns (the “Program Entities”) the non-exclusive, royalty-free, and irrevocable rights to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, and otherwise exploit your Caption and to incorporate your Caption in other works in any and all markets and media, now known or hereafter devised, throughout the world in perpetuity, without additional notification, permission, approval, or compensation. You warrant that you have the sole and exclusive right to grant such rights to the Program Entities and the Program Entities’ reproduction, publishing, displaying, and/or other use of your Caption will not infringe on any rights of third parties, including, without limitation, copyright, trademark, patent, privacy, or publicity, or create claims for defamation, false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract.

 

By submitting your Caption, you hereby indemnify, defend, release, discharge, and hold harmless the Program Entities, Facebook, all television broadcasting stations, sponsors, advertising agencies, and any and all others connected with the Show, and each of their related parent companies, subsidiaries and/or affiliated companies, and the officers, directors, employees, agents, partners and representatives of each of the foregoing (collectively, the “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from submitting your Caption.

 

By submitting your Caption, you consent to the recording, use, and reuse by the Program Entities of your Facebook user name, voice, actions, likeness, name, appearance, biographical material, and any other identifying information, including without limitation, any information contained in your Caption, Facebook profile, as used, edited, altered, fictionalized, or modified by the Program Entities, in their sole discretion, in any and all markets and media, now known or hereafter devised, throughout the world in perpetuity, including, without limitation, in and in connection with TPIR, the Website, or related sites or services, in and in connection with any television programs and other productions, and in and in connection with advertising, promotion, and publicity.

 

You acknowledge and agree that TPIR, its licensees, successors, and assigns will be entitled to retain any and all revenue generated from any sales, licenses, assignments, and other transfers of the rights granted by you hereunder, as well as any and all revenue generated by the display of any advertising, publicity, promotional materials, or distribution rights in connection with your Caption or the Materials. Nothing in these Terms of Participation obligates or may be deemed to obligate TPIR or any other person or entity to exercise any of the rights granted by you under these Terms of Participation. TPIR and its successors, licensees, and assigns, will have the unlimited right to assign these Terms of Participation and the rights granted by you under these Terms of Participation at any time, in whole or in part, to any party. Your Caption may not be identifiable. TPIR will have the right to make any changes to your Caption as it determines in its sole discretion. Your Caption should not contain material that is violent, pornographic, obscene, illegal, inappropriate, or racially or morally offensive. Your Caption must be your own original work, so it must not contain any intellectual property or other material that you do not solely own and control, such as music, artwork, etc. You agree that TPIR and its licensees, successors, and assigns shall have no obligation to give you credit for your Caption but in their sole discretion may elect to do so.

 

You understand that there will be no payment for your Caption or the use of your Caption. You understand that no industry custom or practice applies to your agreement that you will not be paid for your Caption. You understand that if your Caption is selected for use, such use will not be considered an employment opportunity. If you do not want your Caption to be used and broadcast by the Program Entities, then please do not participate. You understand that neither TPIR nor any other party is obligated to use or exploit your Caption.

 

To the extent that the Website’s Terms of Services, located at https://www.priceisright.com/terms-of-services/ (the “Website Terms”), are in conflict with these Terms of Participation, the Website Terms shall apply.
