ELIGIBILITY REQUIREMENTS & TERMS AND CONDITIONS

The Price Is Right Productions, and its distribution, production, administrative, advertising, and promotion agencies (“TPIR”) invite you to join in on the fun of THE PRICE IS RIGHT “Announcer Search” (the “Announcer Search”) for Season 44 of The Price Is Right (the “Show”) by posting one (1) video of yourself via Twitter (either Twitter native video upload, or link to video platform supported by Twitter), tagging @priceisright and using the hashtag #TPIRannouncer (the “Video”). In your Video, you must include the following phrase: “It’s a NEW CAR!” (See “Winner Selection” for judging criteria).

 

If your Video (i) does not tag @priceisright, (ii) does not use the hashtag #TPIRannouncer and (iii) is not posted to Twitter per the below instructions, it will not be considered to be submitted in the Announcer Search.

 

If you have a protected (private) Twitter account, you must send @priceisright your Video via a Twitter Direct Message. Here is how:

  1. Tap the envelope icon.
  2. Tap the new Message icon to create a new Message.
  3. In the address box, enter @priceisright.
  4. Enter your message, which must include the Video and #TPIRannouncer.
  5. Click Send.

 

Your Video should be original, only include you, and not infringe on any third party rights, including without limitation, copyright, trademark, or patent, or create claims for idea misappropriation or breach of contract. No Videos will be accepted after 11:59:59pm ET on December 17, 2015. Sponsored by TPIR.

 

TPIR will only review the FIRST Video you submit (based on the timestamp on Twitter). If you submit multiple videos, only the first Video will be reviewed.

 

A valid Twitter account is required to enter into this Announcer Search. Twitter accounts are free. To set up a Twitter account, visit https://twitter.com/signup for complete details. You must follow @priceisright on Twitter.

 

In order to participate, you must meet the following eligibility criteria:

 

  • You must be eighteen (18) years of age or older at the time of application.
  • You must be a legal resident of the United States (excluding Puerto Rico) and live in the United States as of the date you submit your Video and continuing through the dates of travel to Los Angeles, CA, if you are selected as a finalist.
  • You must not be a candidate for public office at the time of entry, and if selected to be an announcer, you must agree not to become a candidate for public office until after the initial broadcast of the program in which you appear.
  • You must be eligible to render announcing services per the applicable guild regulations (as necessary).
  • You must be a legal permanent resident of the U.S., or possess a current legal visa allowing you to seek employment freely in the U.S. (not merely a work visa that allows one to work for one particular employer).
  • Satisfy the Terms of Participation (see below)

 

You are not eligible, if:

  • You are not eligible to render announcing services per the applicable guild regulations;
  • You are not eligible to seek employment freely in the U.S.; and/or
  • You do not meet the other eligibility requirements set forth above.

Employees, officers, directors and agents of CBS Corporation, CBS Broadcasting Inc., The Price Is Right Productions, Inc., Fremantle Goodson, Inc., or Fremantle Media North America, Inc. (and any parent, subsidiary, or affiliate of any of the foregoing), and local and national sponsors of THE PRICE IS RIGHT and/or of any of their respective licensees, assigns, partners, parents, subsidiary, or affiliated companies and their immediate family (spouse, mother, father, sister, brother, daughter or son, regardless of where they live) or members of their same households (whether related or not) are not eligible to be participants in the Announcer Search or participate in the application process.

 

You are required to provide truthful information and TPIR may reject and require deletion of any entry that it discovers or determines to be false or fraudulent. TPIR may disqualify any entry from individuals who do not meet the eligibility requirements.

 

Your Video must NOT contain material which is sexually explicit, obscene, pornographic, violent (for example, relating to murder, weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, national origin, physical disability, sexual orientation or age), illegal (for example, underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane or harassing. Your Video must conform to any terms of use/service associated with Twitter, which are available here: https://twitter.com/tos?lang=en.

 

Contest Submission Phase

Only Videos submitted between 8:00:00am ET on December 14, 2015 and 11:59:59pm ET on December 17, 2015, will be entered into the judging phase described below.

 

TPIR shall act as official timekeeper, and all decisions regarding timing of entries shall be at TPIR’s sole discretion.

 

Judging

 

Your Video must not exceed thirty seconds (:30s) in length. Videos of longer duration may be disqualified.

 

The Videos and answers to any questions asked to help determine the Prize winner during the interviews in Los Angeles will be judged by personnel from THE PRICE IS RIGHT based on the following criteria: 33.3% clarity of announcement, 33.3% personality, and 33.3% enthusiasm. In the event of a tie, the entry with the higher score in the personality category will be declared the finalist. Your video must include the phrase “IT’S A NEW CAR!” or will NOT be considered.

 

Remember: Your Video must adhere to the time restriction above, so make sure to show your spirit within the time allotted.

 

Winner Selection

 

One (1) finalist will be selected. The finalist will not be officially declared until such individual fills out, signs and returns all required paperwork, which may include a Release and Waiver and Confirmation of Travel Availability. The finalist must be willing to travel to Los Angeles between January 12, 2016 and January 14, 2016 (or as scheduled by the TPIR). If finalist is unable to travel to Los Angeles on the dates selected by TPIR, he or she will not be officially declared finalist, and TPIR may choose an alternate finalist.

 

All of TPIR’s decisions with respect to the Announcer Search are final and in TPIR’s sole and absolute discretion.

 

The finalist will have the opportunity to act as the guest announcer in one (1) game of one (1) episode of THE PRICE IS RIGHT, where a car is offered as a prize. TPIR will interview the finalist in Los Angeles, and said finalist must also fill out, sign, deliver and agree to all of the terms and conditions of additional forms, including, without limitation, an Arbitration Provision.

 

Prize

The Prize (“the Prize”) for the finalist shall consist of:

 

Air Travel: One (1) roundtrip coach airfare for the selected finalist from the closest major airport to the finalist (or other airport as selected by TPIR) to Los Angeles, CA.

 

Hotel Accommodations: one (1) night standard hotel accommodations (room and tax only) in Los Angeles, CA (at a hotel selected by TPIR).

 

Ground Transportation:

  • Ground transportation to and from the hotel in Los Angeles, to the Los Angeles International Airport.
  • Ground transportation to and from the hotel to the set for THE PRICE IS RIGHT taping.

 

SAG-AFTRA scale payment for each airing episode. For the avoidance of doubt, SAG-AFTRA scale payment(s) shall not constitute part of the Prize for tax purposes.

 

Please note that the Prize is not refundable or transferable, and cannot be substituted or exchanged for cash or credit at any time.

The Finalist winner is responsible for the full cost of transportation to and from the airport in his/her hometown and all taxes related to that transportation.

 

Hotel and travel (as outlined) must be booked by TPIR and arrangements cannot be changed in any way once booked and confirmed.

 

Approximate value of each finalist Prize is $1,600.00, depending upon the cost of air travel. The Prize does not include items not specified, such as travel insurance, hotel room service and other incidental charges, parking fees, laundry service, food, beverages, merchandise, or souvenirs, etc. The Prize winner also will be responsible for any taxes related to this contest and/or prizes won as a result of their participation as a contestant in an episode of THE PRICE IS RIGHT, if any.

 

By accepting the Prize, you acknowledge that you are not guaranteed to receive a prize of monetary value on THE PRICE IS RIGHT or the opportunity to be called on stage.

 

TPIR may elect, in its sole discretion, to feature Videos submitted as part of the Announcer Search in one or more episodes of THE PRICE IS RIGHT or related promotional materials.

 

TPIR reserves the right to change or make exceptions to any of the rules, eligibility requirements and terms, including the terms of any prizes to be awarded at any time without notice.

 

TPIR reserves the right to add, cancel and/or substitute other means of participation and TPIR reserves the right to modify the manner in which the Announcer Search is conducted.

 

Other Conditions (the “Terms of Participation”)

Payments of all federal, state and local taxes are solely the responsibility of the finalist. The finalist may be required to complete and submit an IRS Form W-9 with his/her full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by TPIR in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the Prize. Such winnings of $600 or more will be reported to the IRS.

 

Participation in the Announcer Search and/or acceptance of the Prize constitutes entrant’s and/or winner’s permission for TPIR or its agents and designees to interview the finalist, to photograph, film, and record the finalist, and to use in commerce and in any media his/her name, address (city and state), biographic information, likeness, photograph, audio or video recording, and/or any statements made by him/her regarding TPIR, the Announcer Search, and/or its sponsor(s) for purposes of trade, publicity, or promotion without notice or additional compensation, except where prohibited by law. The finalist agrees to sign a publicity release confirming such consent prior to acceptance of the prize, except where prohibited by law.

 

If selected as finalist, you may also be required to meet with the press to promote your appearance on the Show. Press appearances are subject to your availability. You also authorize TPIR to conduct civil, criminal, financial, driver-history and any other type of background checks deemed necessary by TPIR. All dates and locations listed in these eligibility requirements and in the application form are subject to change in TPIR’s sole discretion, without notice.

 

If you are chosen to be finalist, TPIR shall not be responsible for making any necessary arrangements with your employer and family in anticipation of your absence from home and your job.

 

You understand that although you may believe your Video to be unique and novel, there may be pre-existing ideas, concepts, or proposals that are similar to your Video. By submitting your Video, you recognize that other persons, including TPIR’s own employees, may have submitted to TPIR or others, or made public, or may in the future originate and submit or make public, similar or identical ideas, concepts, or proposals that TPIR may have the right to use, and you understand that you will not be entitled to any compensation because of TPIR’s use of such similar or identical ideas, concepts, or proposals in any manner. You understand and agree that TPIR’s use of material containing features or elements similar or identical to those contained in your Video will not obligate TPIR to negotiate with you or entitle you to any compensation if TPIR determines that it has an independent legal right to use that other material for any reason (for example, because the features or elements are not new or novel, were not originated by you, or were or may hereafter be independently created and submitted by other persons, including TPIR employees).

 

By submitting your Video, you agree that your Video, in whole or in part and as edited by TPIR in its sole discretion, may be exhibited in the Show (distributed in all media, worldwide), on the Show’s websites (collectively, the “Website”) and in advertising for the Show on-air and off-air and on the Website and on social media platforms related to the Show (together, the “Materials”) and that TPIR may exploit your Video and the Materials howsoever it chooses in any and all markets and media now known or hereafter devised, throughout the world in perpetuity, without additional notification, permission, approval, or compensation.

 

You grant TPIR, FremantleMedia North America, Inc., Fremantle Goodson, Inc., CBS Corporation, CBS Broadcasting Inc., and their respective parent, subsidiary, and affiliate companies, and their licensees, successors and assigns (the “Program Entities”) the non-exclusive, royalty-free, and irrevocable rights to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, and otherwise exploit your Video and to incorporate your Video in other works in any and all markets and media, now known or hereafter devised, throughout the world in perpetuity, without additional notification, permission, approval, or compensation. You warrant that you have the sole and exclusive right to grant such rights to the Program Entities and the Program Entities’ reproduction, publishing, displaying, and/or other use of your Video will not infringe on any rights of third parties, including, without limitation, copyright, trademark, patent, privacy, or publicity, or create claims for defamation, false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract.

 

By submitting your Video, you hereby indemnify, defend, release, discharge, and hold harmless the Program Entities, Twitter, all television broadcasting stations, sponsors, advertising agencies, and any and all others connected with the Show, and each of their related parent companies, subsidiaries and/or affiliated companies, and the officers, directors, employees, agents, partners and representatives of each of the foregoing (collectively, the “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from submitting your Video.

 

By submitting your Video, you consent to the recording, use, and reuse by the Program Entities of your Twitter user name, voice, actions, likeness, name, appearance, biographical material, and any other identifying information, including without limitation, any information contained in your Video, Twitter profile , as used, edited, altered, fictionalized, or modified by the Program Entities, in their sole discretion, in any and all markets and media, now known or hereafter devised, throughout the world in perpetuity, including, without limitation, in and in connection with TPIR, the Website, or related sites or services, in and in connection with any television programs and other productions, and in and in connection with advertising, promotion, and publicity.

 

You acknowledge and agree that TPIR, its licensees, successors, and assigns will be entitled to retain any and all revenue generated from any sales, licenses, assignments, and other transfers of the rights granted by you hereunder, as well as any and all revenue generated by the display of any advertising, publicity, promotional materials, or distribution rights in connection with your Video or the Materials. Nothing in these Terms of Participation obligates or may be deemed to obligate TPIR or any other person or entity to exercise any of the rights granted by you under these Terms of Participation. TPIR and its successors, licensees, and assigns, will have the unlimited right to assign these Terms of Participation and the rights granted by you under these Terms of Participation at any time, in whole or in part, to any party. Your Video may not be identifiable. TPIR will have the right to make any changes to your Video as it determines in its sole discretion. Your Video should not contain material that is violent, pornographic, obscene, illegal, inappropriate, or racially or morally offensive. Your Video must be your own original work, so it must not contain any intellectual property or other material that you do not solely own and control, such as music, artwork, etc. You agree that TPIR and its licensees, successors, and assigns shall have no obligation to give you credit for your Video but in their sole discretion may elect to do so.

 

You understand that there will be no payment for your Video or the use of your Video. You understand that no industry custom or practice applies to your agreement that you will not be paid for your Video. You understand that if your Video is selected for use, such use will not be considered an employment opportunity. If you do not want your Video to be used and broadcast by the Program Entities, then please do not participate. You understand that neither TPIR nor any other party is obligated to use or exploit your Video.

 

To the extent that the Website’s Terms of Services, located at https://www.priceisright.com/terms-of-services/ (the “Website Terms”), are not in conflict with these Terms of Participation, the Website Terms apply.
